AGENT APPOINTMENT AND RESPONSIBILITIES

1. Eligibility and Qualifications

In accordance with the Elections Act (2011) and the CIPA Constitution, an individual seeking to represent the party as an agent must meet the following criteria:

  • Citizenship and Registration: Must be a Kenyan citizen and a registered voter in the respective constituency or ward.
  • CIPA Membership: Must be an active member of CIPA with a verified digital profile.
  • Integrity Standards: Must adhere to the requirements of Chapter Six of the Kenyan Constitution (Leadership and Integrity).
  • Neutrality: Must not be an employee of the IEBC or a person holding a position that creates a conflict of interest with electoral neutrality.

2. Core Roles and Responsibilities

Under Election Regulation 30, a CIPA Agent is tasked with safeguarding the party’s interests through the following actions:

  • Process Witnessing: Witnessing the opening of ballot boxes, the sealing of containers, and the verification of serial numbers before polling begins.
  • Monitoring: Observing the entire voting process to ensure compliance with the Elections Act and reporting any irregularities in real-time via the CIPA Digital Portal.
  • Tallying and Counting: Witnessing the sorting, counting, and tallying of votes at the polling station and tallying centers.
  • Statutory Forms: Reviewing and signing the official results forms (e.g., Form 34A) upon completion of the count. If an agent refuses to sign, they must document the reasons for the refusal as per the law.

3. Agent Code of Conduct

To uphold the party’s 10 Pillar Manifesto, all agents must abide by the ORPP Code of Conduct for Political Parties:

  • Non-Interference: Agents must not interfere with the duties of the Presiding Officer or the voting secrecy of any elector.
  • Identification: Must wear the official IEBC-issued identification badge and CIPA accreditation at all times within the polling center.
  • Professionalism: Maintain a high standard of conduct, avoiding any behavior that could be perceived as intimidation or campaigning within the prohibited radius of the polling station.
  • Confidentiality: Protect the privacy of voters while ensuring the transparency of the count.

4. The Digital Application Process

Consistent with CIPA’s fully digitized model, the application and appointment flow is managed through the website:

  1. Application Submission: Log in to your member profile and select the “Apply as Agent” option.
  2. Electoral Mapping: Confirm your County, Constituency, and Polling Station.
  3. Training and Certification: Complete the mandatory CIPA Agent Training Module (digital) covering the Elections Act and the “Uwazi” reporting tools.
  4. Accreditation: Upon approval by the National Election Board (NEB), your appointment letter will be generated digitally and synced with the ORPP IPPMS for IEBC accreditation.

5. Legal Protections and Limitations

  • Protection: The Kenyan Constitution (Article 81) guarantees a free and fair election; agents are legally protected while performing their oversight duties.
  • Absence: Per Section 30 (4) of the Elections Regulations, the absence of an agent at a polling station does not invalidate the proceedings, provided the party was given the opportunity to appoint one.

6. Real-Time Reporting (The Uwazi Edge)

CIPA agents are required to use the CIPA Mobile Reporting Interface to:

  • Log the opening and closing times of their assigned station.
  • Upload a digital image of the final signed Form 34A for parallel tallying.
  • Submit incident reports immediately to the party’s Internal Dispute Resolution Mechanism (IDRM) if legal intervention is required.

By clicking “I Agree and Apply,” you enter into a digital binding agreement with the Civic Progress Party (CIPA) to serve as an official Party/Candidate Agent. This agreement is governed by the CIPA Constitution, the Elections Act (2011), and Article 81 of the Constitution of Kenya.

AGENT TERMS OF SERVICE AND CLICK-THROUGH AGREEMENT

1. Declaration of Eligibility

I certify that I am a registered voter and a member of CIPA in good standing. I further declare that I meet the integrity standards of Chapter Six of the Constitution of Kenya and am not an employee of the IEBC or otherwise legally barred from serving as a political party agent.

2. Commitment to the 10 Pillars and Neutrality

I pledge to uphold the CIPA 10 Pillar Manifesto throughout the electoral process. I will maintain strict neutrality toward voters and will not engage in campaigning, voter intimidation, or any activity that interferes with the secrecy and integrity of the ballot.

3. Digital “Uwazi” Reporting Protocol

I agree to use the CIPA Digital Portal as my primary reporting tool. My responsibilities include:

  • Using the mobile interface to log the opening and closing times of my assigned polling station.
  • Uploading high-resolution digital copies of signed Statutory Forms (e.g., Form 34A) immediately upon the conclusion of counting.
  • Reporting any electoral malpractices in real-time through the party’s encrypted reporting channel.

4. Code of Conduct and Legal Compliance

I will abide by the ORPP Code of Conduct and Election Regulation 30. I understand that my role is to observe and witness, not to obstruct. I will wear official accreditation at all times and follow the lawful instructions of the Presiding Officer while safeguarding CIPA’s interests.

5. Confidentiality and Data Protection

I acknowledge that I may have access to sensitive electoral data. I agree to:

  • Protect the privacy of all voters.
  • Use the data accessed through the CIPA portal solely for official party oversight.
  • Adhere to the Data Protection Act (2019) regarding any personal information encountered during my duties.

6. Termination and Independent Status

I understand that this appointment is voluntary and does not constitute an employment contract. CIPA reserves the right to revoke my digital accreditation immediately if I violate the Party Constitution, the Elections Act, or the terms of this agreement.

7. Data Synchronization Consent

I authorize CIPA to synchronize my Full Name, ID Number, Sex, and Electoral Mapping (County, Constituency, Ward) with the ORPP IPPMS and the IEBC for the purpose of official accreditation and the issuance of my Agent Badge.
